Terms of Service
These terms govern your use of Case Trail. Enterprise customers operate under a separately-signed Master Services Agreement that overrides this page where the two conflict.
Effective 01 May 2026
01The agreement
By creating an account, accessing the workspace, or using any Case Trail service, you agree to these terms. If you’re accepting on behalf of an organisation, you confirm you have authority to bind it.
02Accounts & access
Case Trail accounts are provisioned by the firm or institute you belong to. Your User ID is a credential — keep it confidential, do not share it, and notify your admin immediately if you suspect misuse.
Sessions expire after 60 minutes of inactivity. Admins can revoke access at any time. You can request data export during your access window.
03Acceptable use
You will not:
- Use Case Trail to harass, defraud, or harm any person
- Upload content you don’t have the right to upload
- Reverse engineer, scrape at scale, or attempt to bypass tenant isolation
- Use the AI Court Notebook to generate content you would file or rely on without independent verification
- Resell or sublicense access to Case Trail
Violations may result in suspension. Severe or repeated violations terminate the agreement.
04Your content
You own your content. Documents you upload, matter records you create, notebook conversations — all remain yours.
You grant Case Trail a limited, non-exclusive licence to process your content solely to operate the service for you: store it, retrieve relevant chunks, run inference, serve search and citation features, generate audit logs, and back it up. We do not train models on your content.
05AI output
The AI Court Notebook is a research assistant, not a substitute for professional legal judgement. Outputs are grounded on documents you uploaded and cite back to source pages — but the final responsibility for accuracy and fitness for filing rests with the advocate or legal team using the output.
Case Trail is not a law firm and does not practise law. We do not provide legal advice.
06Fees & billing
Subscription fees, billing cycle, and any usage-based metering are set out in your Order Form or Master Services Agreement. Self-serve plans are billed in advance; enterprise plans are invoiced per the Order Form. All fees are exclusive of GST.
07Termination & exit
Either party may terminate for material breach with 30 days’ written notice if the breach is not cured. Either party may terminate for convenience at the end of the current term.
On termination, you have 30 days to export your data. After that we delete it on the schedule described in our Privacy Policy.
08Warranty disclaimers
Case Trail is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.
09Limitation of liability
Neither party is liable for indirect, incidental, special, or consequential damages. Our aggregate liability under this agreement is capped at the fees you paid in the twelve months preceding the claim. Enterprise customers operate under negotiated caps in the MSA.
10Governing law & dispute resolution
These terms are governed by the laws of India. Disputes are subject to arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996, before a sole arbitrator. Courts in Bengaluru have exclusive jurisdiction for any non-arbitrable matters.
11Changes
We may update these terms; material changes are emailed to admins at least 30 days before they take effect. Continued use after the effective date is acceptance.
